1. Definitions
“Evaluation means the questionnaire contained on Litmus’s website Questionnaire”
“Manufacturer” means the manufacturer of the Trial Products
“Member” means the volunteer who submits the online application form on Litmus’s website to test the Trial Products.
“Litmus” means Litmus Research Limited of Kintyre House, 70 High Street, Fareham, Hampshire, PO16 7BB (Company No: 04613450).
“Trial Period” means the period of time specified by Litmus for which the Member is obliged to test the Trial Product.
“Trial Products” means the cosmetic products which Litmus may from time to time send to the Member to test.
2. Subscribing as a Member2.1 A volunteer who wishes to become a Member is required to submit an online application form.
2.2 The Member must notify Litmus of any changes in the details supplied in the online application form without delay.
2.3 By submitting the application form the Member agrees to be bound by, and binds any family member under 18 for whom the Member is responsible, to these Terms and Conditions.
2.4 The Member may be issued with a username and/or password. The member must keep these secret and secure and may not share these or transfer them to any other person. The Member must notify Litmus immediately if any other person becomes aware of the username and / or password. The Member is responsible for any use made of the username and/or password, even if that use is by another perso
3. The Trial Process3.1 Litmus will use the information submitted by the Member in the online application form in order to determine which Trial Products may be sent to the Member to be tested.
3.2 Litmus may from time to time send Trial Products to the Member to test, but Litmus is under no obligation to send any Trial Products or to continue to send Trial Products to the Member to test.
3.3 Any Trial Product which Litmus supplies to the Member to test will be sent to the address specified by the Member on the online application form.
3.4 The Member must use the Trial Product for the Trial Period and in accordance with any instructions supplied by Litmus to the Member.
3.5 In the event that the Member suffers an adverse reaction to the Trial Product, the Member should immediately stop using the Trial Product and inform Litmus of the details of the adverse reaction without delay.
4. The Trial Products4.1 Litmus does not promote or endorse any Trial Products.
4.2 Litmus may not be permitted to supply the brand name of or other information about the Trial Products and Litmus is therefore not obliged to disclose any information about the product to you.
4.3 The Trial Products have not been tested on animals.
4.4 The Trial Products have already been subject to and passed all relevant safety tests and are to be tested by the Member for performance and effectiveness only.
4.5 Use of the Trial Product, like the use of other cosmetic and toiletry products, may cause an adverse or allergic reaction. The member confirms that he has no history of any condition or allergy which may be caused or aggravated by the use of a cosmetic product. The member agrees to notify Litmus as soon as he becomes aware of any such allergy or condition arising and agrees that Litmus are not responsible for sending a Trial Product which causes or aggravates any such allergy or condition unless the member has notified Litmus of it.
4.6 Litmus offers no guarantee as to the quality of the Trial Products supplied by Litmus to the Member.
5. Use of the Trial Product5.1 The Member must store any Trial Product safely and away from small children and animals.
5.2 The Member must notify Litmus of any damaged Trial Product received by the Member as soon as reasonably practicable after its receipt.
5.3 The Member must dispose of any damaged or unused Trial Product safely.
6. Returning the Trial Product5.4 The Member must not sell, give or lend the Trial Product to any other person.
6.1 The Member is entitled to keep the Trial Product at the end of the Trial Period without charge subject to clause 6.2.
6.2 Litmus is entitled to ask the Member to return the Trial Product and the Member agrees to return any Trial Product when asked to do so.
6.3 Where the Member is asked to return the Trial Product to Litmus they should do so in the envelope supplied by Litmus.
7. Charges7.1 The Member will not receive a reward for testing the Trial Product but is entitled to keep the Trial Product free of charge except where Litmus asks the Member to return the Trial Products under clause 6.2.
7.2 Litmus is liable for the reasonable postage and packing costs of the Member returning any Trial Products to Litmus.
7.3 The Member is responsible for any standard charges, such as the charges of ISPs and telephone charges incurred in completing both the online application form and submitting the Evaluation Questionnaire.
8. Evaluation Questionnaire8.1 The Member must not use foul language when completing the Evaluation Questionnaire.
8.2 Litmus is under no obligation to use the information supplied by the Member in the Evaluation Questionnaire.
9. Cancellation of Membership9.1 Litmus has the right to suspend or cancel the Member’s membership at any time without notice.
9.2 The Member may cancel their membership by deleting their members on the website.
10. Liability
10.1 Litmus is not liable:-
10.1.1 for the loss of any Trial Products which the Member is expecting to receive;
10.1.2 for any adverse reaction and/or irritation and/or other injury and/or any consequent loss of income which the Member suffers as a consequence of using the Trial Product save where Litmus is negligent or where liability arises under the Consumer Protection Act 1987;
11. Confidentiality11.1 The Member must keep all information about all Trial Products strictly confidential.
11.2 The Member will make it clear to all immediate family members that all information about the Trial Products is confidential.
12. General12.1 The contract shall be governed by the laws of England and both Litmus and the Member agree to submit to the jurisdiction of the English courts. Both Litmus and the Member can also pursue remedies in courts of any other appropriate jurisdiction.
12.2 If any of these terms and conditions are held by a court or other competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of the contract and the remainder of the term or condition in question shall not be affected.
13. Privacy and Data Protection
13.1 Litmus Research Limited is the Data Controller for the purposes of the Data Protection Act 1998. You may contact us at Litmus Research Limited of 23 Privett Place, Gosport, Hampshire PO12 3SG.
13.2 The information you provide to us when you apply for membership and return Evaluation Questionnaires will be used by us in order to administer your membership and to evaluate the Trial Products. That information may also be supplied to the manufacturers and suppliers of the Trial Products, but we will not pass your name and address to them or to any other third party, except where required to do so by law.
13.3 In order to provide anonymised information to the manufacturers and suppliers of the Trial Products, it may be necessary to transfer that anonymised data to companies outside the European Economic Area. By applying for membership you agree to that anonymised information being used in that way.
13.4 The information which you provide to us when applying for membership or completing Evaluation Questionnaires may include information which is related to your racial or ethnic origin, and your health. By applying for membership, you consent to the use of that information.
